Legal Requirements by State & Territory

The sale and supply of alcohol in Australia is regulated by state and territory laws. Penalties apply for any breach. Below is a summary of the relevant legislation:

Australian Capital Territory (ACT)

Under the Liquor Act 2010, it is an offence to supply alcohol to a person under the age of 18.
Penalty: Up to $5,500.

New South Wales (NSW)

Under the Liquor Act 2007, it is an offence to sell or supply alcohol to, or obtain alcohol on behalf of, a person under the age of 18.
Penalty: Fines exceeding $11,000 and/or imprisonment.

Northern Territory (NT)

Under the Liquor Act 2019, it is an offence to supply liquor to a person under 18 years.
Penalty: Up to 50 penalty units (approx. $8,100).

Queensland (QLD)

Under the Liquor Act 1992, it is an offence to supply liquor to a person under the age of 18.
Penalty: Fines over $11,000 may apply.

South Australia (SA)

Under the Liquor Licensing Act 1997, it is an offence to sell or supply alcohol to persons under 18.
Penalty: Up to $20,000.

Tasmania (TAS)

Under the Liquor Licensing Act 1990:

  • It is illegal to deliver liquor to a person under 18.

  • A person under 18 cannot purchase liquor.
    Penalties:

  • Supplier: up to 20 penalty units (approx. $3,920)

  • Minor: up to 10 penalty units (approx. $1,960)

Victoria (VIC)

Under the Liquor Control Reform Act 1998:

  • Supplying alcohol to a person under 18 is an offence.
    Penalty: Over $19,000

  • A person under 18 must not purchase or receive alcohol.
    Penalty: Over $800

Western Australia (WA)

Under the Liquor Control Act 1988, it is an offence:

  • To sell or supply alcohol to a person under 18 on licensed or regulated premises

  • For a person under 18 to purchase or attempt to purchase alcohol
    Penalty: Up to $10,000

Compliance & Delivery

  • A person 18 years or older must be present at the delivery address to accept alcohol orders.

  • Valid photo ID is required at the time of delivery.

  • Amberfire Distillery reserves the right to refuse delivery if the recipient appears underage or intoxicated.
